We are often asked to complete forms assessing patients’ mental capacity to, for example, write a will or make a power of attorney decision. We understand that solicitors sometimes request that GPs do this task. This is not an NHS task but is something that some GPs do for a significant fee. Recent advice from the legal profession suggests that GPs are not ideally placed to complete these forms and therefore, from 20 April 2016, we will no longer be completing these forms. Private psychiatrists are able to complete them and it is our understanding that solicitors can also sometimes complete them.
